Terms and Conditions
1. Parties
a) Yemek Sepeti Elektronik İletişim Perakende Gıda A.Ş., located at the address of Esentepe Mahallesi Dede Korkut Sokak No: 28/1 Şişli/İstanbul (Yemeksepeti) that provides various services through the www.yemeksepeti.com website and Yemeksepeti mobile application/applications (“Yemeksepeti Platforms”)
b) A real person who creates an order request for goods or services by registering on the Yemeksepeti Platforms through the system, and who acquires, uses, or benefits from such goods or services for non-commercial or non-professional purposes (“User”).
These Terms and Conditions shall apply for the guest checkouts, as it deems appropriate at Yemeksepeti’s sole discretion.
2. Scope and Services
The subject of this Terms and Conditions (“Agreement”) is the terms of benefiting from the services to be provided to the User through Yemeksepeti Platforms and the rights and obligations of the Parties.
Yemeksepeti offers users the opportunity to order food, grocery products etc. and other related services from the internet, mobile applications, smart TV systems or applications that can be developed on similar platforms.
Yemeksepeti is a digital platform that acts as an intermediary between member merchants and users. It performs its duty as an intermediary service provider by bringing together the products of member merchants with users. However, in some cases, Yemeksepeti Platforms may also be the supplier of its own products or services.
3. User’s System
Yemeksepeti allows users to register for its Platforms under these Terms of Use by filling in the relevant information in the registration section or via provided social media networks or accounts such as Apple, etc. Yemeksepeti may request further information or documentation from the user to comply with its legal and regulatory obligations. It reserves the right to perform verification via a One-Time Pin (OTP) sent through SMS or messaging platforms such as WhatsApp or any other similar communication applications at its sole discretion. In the event that any of these processes are not completed, the user rights and authorizations defined in this Agreement cannot be granted. The User accepts and undertakes to comply with the provisions of this Agreement concluded with Yemeksepeti throughout the duration of the membership.
The users accept and undertake that they are over the age of 18, and that they use Yemeksepeti Platforms if they are under the age of 18 only with the consent of their parent or legal guardian.
Each user needs an e-mail address and a "password" to be determined by himself in order to register on Yemeksepeti Platforms and access the system. Login steps should be followed to access social media accounts or other specified accounts.
“Password” is only within the knowledge of the relevant user. If the User's password is forgotten, the system will send a link to the user's email address registered in the Yemeksepeti system upon request to create a new password. Determining and protecting the password is the sole responsibility of the user and Yemeksepeti is not responsible for any problems or damages that may arise from the use of the password.
Yemeksepeti assumes that the person logging into Yemeksepeti Platforms using a registered email address and password is the user under this Agreement, and Yemeksepeti has no obligation to investigate the source and authority of the entries made.
Users can determine their preference regarding allowing e-service promotions, advertisements, campaigns, advantages, surveys and other customer satisfaction applications to be offered to them within the scope of the applications in effect and/or to be implemented by Yemeksepeti. Notifications regarding the order confirmation sent to the User are not accepted as commercial messages.
Yemeksepeti only shares the User's name, address, and phone number with the member merchants who will deliver the order for the only purpose of providing that the purchase is delivered correctly.
Regarding the role of Yemeksepeti as an intermediary service provider, it is not responsible for any problems or damages that may arise between the User and the member merchant due to the sharing of the name, address and telephone number registered in its system with the member merchant that delivered the order.
Yemeksepeti may anonymize the data and issue reports without disclosing the user information, or use such information or reports itself, and may share these reports and/or statistics with its business partners and third parties, with or without charge.
4. Obligations of the User
User agrees, declares and undertakes following subjects while using the services of Yemeksepeti through Yemeksepeti Platforms:
The information shared within the member form is correct and accepted that only one verified phone number shall be registered for each user that connected to the User account, however this number can be changed by verifying again,
Yemeksepeti reserves right recourse to the User and to claim compensation for the damage suffered due to the fact that the information provided by the user while becoming a member is not correct and/or belongs to another and Yemeksepeti does not waives the exercise of this right if it does not use any of its rights in this regard,
In some cases contents might not be appropriate for people under 18 and Yemeksepeti shall not be held liable for the viewing of this content through unduly means,
Yemeksepeti shall not be liable for any information, messages or files which may be lost and/or received incomplete or delivered to the wrong address while using the services of Yemeksepeti,
Not to access the services provided by Yemeksepeti Platforms in a way other than and/or unauthorized manner, and not to change the software in any way, not to use the ones that are known to have been changed, and to cover all material and moral damages that Yemeksepeti may incur in cases where they do not comply with the aforementioned rules,
In accordance with the Regulation on the Procedures and Principles Regarding the Sales and Presentation of Tobacco Products and Alcoholic Beverages and the relevant legislation, selling of tobacco products and alcoholic beverages over Yemeksepeti is strictly forbidden and the user shall not procure tobacco products and alcoholic beverages via Yemeksepeti and make any such request to member merchants and that any activities to the contrary may result in the cancellation of membership and termination of the this Agreement and in this case and in this case agrees to pay for any damages that Yemeksepeti might suffer,
Yemeksepeti shall not be liable for damages which may arise due to usage, sharing or publishing of user shares by the unauthorized third persons,
User shall not harass or threaten other users,
Users shall not act in any way that will adversely affect the usage of Yemeksepeti system by other users,
Users shall not publish, copy or distribute immoral, inappropriate or illegal material or information or material or information that may cause defamation, humiliate people or institutions
Users shall not make advertisement, sell or make offer for the sale of any goods or services, carry out survey, contest or chain mailing activities
Users shall not engage in activities (spam, viruses, Trojans, etc.) that prevent or impede others from using the Services, not send information or programs that may harm information or software in other users computers
Any record or material received through using Yemeksepeti services is solely within the user’s consent and users bear the sole responsibility for breakdowns, loss of information and other losses that may occur in their own computers and users shall not claim damages from Yemeksepeti for any damages that may arise from using Yemeksepeti system,
Users shall not use Yemeksepeti services for commercial or advertorial purposes without obtaining consent from Yemeksepeti,
User accepts that; Yemeksepeti reserves the right to suspend users membership or remove user from its system permanently in cases where any violation of the Terms, applicable laws or good faith/moral rules by user is determined,
Yemeksepeti may use its own system for commercial purposes,
Users shall not transfer information whose transferring is forbidden by law and shall not share data such as chain mail, software virus, etc. for which no authorization of transmission exists,
Users shall not record, publish, abuse personal information of others
When the payment is not made via Online Payment Method, the user is obliged to make the payment for the amount of the services of which user has been previously informed of, at the time of delivery through the chosen payment method, and if otherwise, the delivery may not be completed,
For orders to be delivered by Yemeksepeti, the service fee set for the delivery of the order may be paid by the user,
The service fee may vary,
The orders placed may be subject to additional terms and conditions determined by the member merchant
It may vary according to the delivery regions of the member merchant that can order;
The prices on Yemeksepeti may differ from the prices offered by member merchant elsewhere (on other platforms, their own menus, member merchant's websites, etc.);
Cookies are used in Yemeksepeti Platforms and cookies are pieces of information transferred by the website to the cookie file in the hard disk of user’s computer and they enable users to surf through Yemeksepeti and help to provide content matching the needs of the user’s accessing the website, when necessary.
5. Authorities Granted to Yemeksepeti
Yemeksepeti may temporarily suspend or completely stop the operation of the system at any time.
Yemeksepeti holds the rights to change the content of the site at any time, modify, terminate any service provided to users, or delete user information and data stored in the system of the user upon request.
Yemeksepeti may temporarily suspend, restrict or completely stop the additional features it offers for online payment options of a relevant user via Online Payment Method for the user transactions that raise security concerns. Yemeksepeti shall not have any liability against its users or third parties due to temporary suspension or completely stopping of the system or use of the Online Payment Method. Furthermore, in the event that Yemeksepeti, at its sole discretion, determines that any user activities give rise to security concerns, Yemeksepeti shall be entitled to partially or fully restrict, block, suspend, or terminate the User’s membership.
Email address and password shall be viewed and approved upon completion of the application spaces provided by Yemeksepeti. Yemeksepeti may exclusively and for an indefinite period, prevent users, who have completely filled in the user registration form or the users who have logged in to the system, to have a new password or to use their existing passwords.
Products on Yemeksepeti Platforms are limited to availability of member merchants menus at the time of order. Yemeksepeti may not be able to deliver products that are not available at the relevant member merchants to the user. Yemeksepeti is not responsible for the content provided by member merchants.
Display of the products on Yemeksepeti does not imply that the products are in stock. Member merchants in Yemeksepeti Platforms are responsible for changing the information with respect to the price and features of the products offered for sale on the Yemeksepeti Platforms.
In case of an incorrect price and product feature information, Yemeksepeti Platforms may inform the users and deliver the product accordingly or cancel the order.
Yemeksepeti will exercise due care for provision of fair and honest explanations regarding the contents of the products offered for sale in the Yemeksepeti Platforms; however, Yemeksepeti bears no responsibility for the problems or damages which may arise due to missing and/or faulty explanations of the member merchant s regarding the content of the orders.
Yemeksepeti may redirect the users to web-sites outside of the Yemeksepeti Platforms. In this case, the user accepts that Yemeksepeti is not responsible for the contents of these platforms.
Yemeksepeti may switch services that require no user membership to services that require membership, open additional services, partially or completely change some of its services or turn them into paid services. In this case, the user has the right to terminate the Agreement and to resign from membership.
Yemeksepeti can make changes in the performance of the hereby Agreement, can change some of its clauses or add new clauses for future technical necessities and compliance with the legislation.
You can request to terminate your Yemeksepeti membership at any time. In this case, you can do this yourself according to the suitability of the system or you can send your request to info@yemeksepeti.com. Also Yemeksepeti reserves the right to suspend user’s membership or restrict or remove the user from Yemeksepeti permanently in cases where any violation of the Terms, applicable laws or good faith/moral rules by the user is determined.
If the user sends an extra request to Yemeksepeti regarding the order, Yemeksepeti will make reasonable efforts (in cases under the responsibility of Yemeksepeti) to fulfill your request. However, Yemeksepeti holds the right not to fulfill the request if the request is measured, fulfillable and does not comply with Yemeksepeti procedures. In these cases, Yemeksepeti will not be responsible for the cancellation/change of the order.
Yemeksepeti is in the position of an intermediary service provider in accordance with the service it provides, it is the sole responsibility of the member merchant to transmit information about the contents of the products. In this respect, Yemeksepeti has no obligation to notify about allergen products. Yemeksepeti does not guarantee that the products supplied by the member merchants do not contain allergens.
Yemeksepeti will be able to request a photograph showing the complaint regarding the order subject to the complaint, in the complaints submitted by the users.
Yemeksepeti may provide gift coupons for its users to be used in Yemeksepeti orders. And also Yemeksepeti holds the right to offer discounts and promotions. Coupons may be subject to validity periods and terms of use. Yemeksepeti holds the right to invalidate, terminate and change the conditions of the use of any coupon without prior notice. The scope of member merchants where coupons can be used can be determined by Yemeksepeti.
Yemeksepeti will be able to provide a system where users can receive their orders directly from the member merchant. In this case, Yemeksepeti will not be responsible for delays, damage to products, quality of products and similar situations experienced by the member merchant.
Yemek Sepeti may share the phone number associated with your account and/or the one provided in the address field with the merchants for the purpose of delivering your order.
6. Intended Use
The User acknowledges, declares, and undertakes that User shall use the Yemeksepeti Platforms and all content, materials, and elements available on the Yemeksepeti Platforms in compliance with this Agreement, the rules of the Yemeksepeti Platforms, the applicable legislation, and moral standards, and that any legal and criminal liability arising from any use in violation thereof shall belong solely to the User. In the event that Yemeksepeti detects any such non-compliant use, Yemeksepeti reserves all rights to make any claims and initiate any actions or proceedings and, at its sole discretion, shall have the right and authority to partially or fully restrict, block, suspend, or terminate the User’s membership.
The User further acknowledges that all orders placed and all purchases made through the Yemeksepeti Platforms are for personal use only and are not intended for resale. In the event that the User places orders for products for wholesale or resale purposes, the User acknowledges that Yemeksepeti shall be entitled to take any necessary measures, including but not limited to refusing to accept and/or deliver such orders and partially or fully restricting, blocking, suspending, or terminating the User’s membership
7. Coupons, Discounts and Promotions
When you make a successful Order from the member merchants listed on the Yemeksepeti Platforms you may be eligible to receive a percentage of the Order value or a fixed amount (“Cashback(s)”) into your Yemeksepeti Wallet Account. In the event of utilization of the Yemeksepeti Wallet account, ‘Yemeksepeti Wallet Terms of Use' shall be applicable.
Yemeksepeti reserves the right to limit or modify the total balance amount in your Yemeksepeti Wallet account. You will not be able to receive Cashbacks that would exceed the limit set by Yemeksepeti into your Yemeksepeti Wallet or bank account.
Your Cashback will be credited to your Yemeksepeti Wallet account immediately after you make an eligible Order that was paid and delivered, unless otherwise stated. Yemeksepeti reserves the right to make changes in the Cashback transfer process.
Cashbacks cannot be earned from cancelled orders. In the event that you cancel your order, Yemeksepeti reserves the right to reclaim any Cashback(s) credited to your account.
Your Cashback will be transferred to your Yemeksepeti Wallet account and can be used for your next eligible order on our Platform. Your Cashback cannot be refunded or exchanged for cash. Cashback is not an obligation that must be fulfilled by Yemeksepeti and/or any member merchant on the Platform. Your Cashback cannot be transferred to any bank or credit card or bank account.
Your Cashback will be valid for the time period stated in the applicable Cashback campaign terms.
Cashbacks are subject to validity periods use restrictions, limits and/or other availability. All Cashbacks are subject to availability on a ‘while stocks last’ basis.
Yemeksepeti reserves the right to exclude the use of the Cashback for certain products or orders at its sole and absolute discretion.
Where Yemeksepeti reasonably determines that you are not eligible for the Cashback, including where the Cashback was awarded due to an error, Yemeksepeti reserves the right to retrieve the Cashback amount without prior notice.
In the event that Yemeksepeti has reasonable suspicion of fraud, an attempt at deception or in the event of the suspicion of other illegal activities in connection with redemption of Cashback on the Platform, Yemeksepeti is entitled at its sole discretion to deduct any Cashback.
Yemeksepeti’s decision on all matters relating to the Cashback shall be final. If there are any discrepancies between these Cashback Terms and Conditions and any brochure, marketing or promotional material relating to any Cashback campaign, these terms and conditions will prevail.
Yemeksepeti shall not be responsible for any failure or delay in transactions which may result in you being omitted from enjoying the Cashback on Yemeksepeti Platforms.
Yemeksepeti reserves the right to change or modify these terms at any time.
Yemeksepeti reserves the right to suspend or terminate the Cashback campaign at any time without prior notice or liability to any party.
8. Payment
The user can make the payment for the orders he/she placed from the Yemeksepeti Platforms in the method the user chose while ordering, from the options provided by the relevant member merchant at the time of delivery. The user can also make instant online payment via using Online Payment Method through his/her bank card, credit card, Yemeksepeti Wallet or a similar payment tool or from other payment systems, various payment functions.
If the card is used unlawfully by someone other than the holder in payments completed form the Online Payment Method, action will be taken pursuant to provisions of the Law on Bank Cards and Credit Cards dated 23.02.2006 and numbered 5464 and the Regulation on Bank Cards and Credit Cards published in Official Gazette dated 10.03.2007 and numbered 26458.
For orders payments of which are completed through the Online Payment Method, receipt/invoice of the order will be issued by the member merchant which received the order and not by Yemeksepeti. For the orders placed by choosing Online Payment Method, Yemeksepeti is exclusively authorized by the member merchant to collect the payments in relation to the orders, from the user on behalf of users
Users shall be deemed to have performed their obligation to make the payment by making the payment to Yemeksepeti where the Online Payment Method is the chosen payment method.
For orders delivered to them by Yemeksepeti and choosing any Payment method, including but not limited to Online Payment Method, payment with credit/debit card on delivery, cash Payment on delivery, Yemeksepeti is exclusively authorized by the member merchant to collect the payments in relation to the orders, from the users on behalf of them. For the orders delivered to them by Yemeksepeti, the users shall be deemed to have performed their obligation to make the Payment against Yemeksepeti and the member merchant , by making the Payment with any Payment method, including but not limited to Online Payment Method, Payment with credit/debit card on delivery, cash payment on delivery.
Yemeksepeti reserves the right to offer additional payment methods and/or remove existing payment methods at any time at its sole discretion.
If you choose to pay using an online payment method, the payment shall be processed by our third party payment service provider. With your consent, your credit card information will be stored with our third party payment service provider for future orders.
9. Product Delivery
If the user is not present at the address (including incorrect address information provided by the user) selected by him/her on the Yemeksepeti system during the product delivery process of the member merchants, the delivery shall certainly not be delivered to any other address. Within this framework, the user is obliged to accept its legal liabilities which may arise due to making an order to an address where he/she is not present.
Priority Delivery
By choosing Priority Delivery, Yemeksepeti user agrees to benefit from this service and pay the additional fee determined by Yemeksepeti within the scope of Priority Delivery.
Priority delivery is a specialized service where your rider brings your order directly. No extra pauses are made to eliminate any waiting that may occur during the delivery.
In most cases, Priority Delivery aims to shorten the delivery time. Still, we would like to emphasize that we cannot guarantee this and the stated delivery time is only an estimate.
Yemeksepeti reserves the right to change the amounts related to the fee for this service (the cost of the service and any fees that may be related to the process) and the Priority Delivery Service fee, which are not mandatory and are to be paid in addition to the delivery fee and order fees, in line with the users' preference, at any time.
It is of course possible to compensate for delays in such deliveries. If you believe you have been harmed in any way, please contact our customer service.
Priority Delivery service can only be used for Yemeksepeti "food" orders with online payment methods. (Excluding Online Meal Card payment options).
Yemeksepeti reserves the right to stop, update, and cancel this service at anytime.
Any coupon that is likely to be identified in the process is single-use and cannot be divided, combined with other coupons, converted into cash, or sold for money.
Delivery PIN Validation
In some cases, once you have confirmed your order and our riders have picked up your order, you will be provided with a unique 4-digit delivery PIN (“Delivery PIN”) on the Order Tracking page on the Platforms. Our riders may require you to provide the said Delivery PIN upon delivery of your order. Our riders are given five (5) attempts to input the Delivery PIN provided by you to our rider in the rider app. In the event our riders have exhausted the attempts and still failed to input the Delivery PIN, our rider may request other verification methods, such as taking a photo of your order with your house/unit number plate.
10. Pick-Up Orders
Users who place orders with Yemeksepeti Pick-Up system will be able to receive orders placed through Yemeksepeti directly from member merchants, and the relevant order will not be delivered to the user's address.
If the order is not received by the user within the specified time, the order price will not be returned to the user.
The user agrees that no changes will be made after using the Yemeksepeti Pick-Up option.
Instant control cannot be made in the system for Yemeksepeti Pick-Up orders. Member merchants are responsible for the up-to-dateness of product stock information and Yemeksepeti has no responsibility.
The User accepts that Yemeksepeti is only an intermediary service provider, so any request or complaint regarding Pick-Up orders should be directed directly to the Merchant.
Yemeksepeti, reserves the right to offer additional discounts and advantages to users who benefit from the Pick-Up service.
Yemeksepeti Pick-Up service is seasonal and does not mean any right allocation.
Yemeksepeti reserves the right to remove, change, stop or cancel the Pick-Up option at any time and without prior notice.
11. Refund
For payments conducted through Online Payment Method, refund of the payment to the user will only be made in the following cases:
Mandatory cancellation of the order due to user’s address being outside of the delivery area of the member merchants;
Mandatory cancellation due to failure to communicate the order to the relevant member merchant;
Cancellation by the user as approved by the member merchants, if the order is not already prepared;
Mandatory partial or full cancellation of the order due to partial or full lack of order supply by the member merchants;
Cancellation due to dissatisfaction upon approval of the member merchants.; and
Cancellation upon approval of the relevant member merchants in case of late delivery of the product ordered.
Unless you change the 'Refund to Wallet' option in the Refund Settings, the refund will be made to your Yemeksepeti Wallet account. Refunds for payments made by Yemeksepeti Wallet or Online Payment Method may vary depending on the procedures of the relevant bank to reflect back to the credit card used by the user. Users making the payment via Online Payment Method may ask for the refund made from their Yemeksepeti Wallet.
If a receipt or invoice related to the order subject to cancellation has been issued and delivered to the user by the member merchants, such receipt or invoice is required to be submitted to the relevant member merchants.
Yemeksepeti holds the right to not to retrain refund of the payment only if the reasons attributable to the user (e.g. User is not present in the delivery address, refuses to take delivery of the order or if the address is incorrect).
Refund of the payments conducted through methods other than the Online Payment and Yemeksepeti Wallet Method is directly made by the member merchants As Yemeksepeti acts as an intermediary only, Yemeksepeti shall not be held liable for the disputes which may arise from the refund.
12. Intellectual Property Rights
All rights in relation to Yemeksepeti, intellectual property rights, Yemeksepeti trademarks, Yemeksepeti trade images or any and all elements of the Yemeksepeti shall belong to Yemeksepeti exclusively.
Users may not use, copy, distribute, create derivative works of, re-publish Yemeksepeti services and Yemeksepeti’s IP rights for any purpose, and it may not engage in or prepare any work derived from such work.
User shall not misuse the services of Yemeksepeti systems and shall not take any action such as to contradict or infringe the rights of other users of the system and shall be solely responsible for any damages which Yemeksepeti or the relevant parties may suffer, and Yemeksepeti holds the right to terminate the account of the concerned user in the relevant service or to terminate or limit the user name, profile picture or similar parts of the account or to terminate the Yemeksepeti membership in case such misusage is identified.
User names, pictures, correspondence, subject matters and nicknames to be added to the system shall comply with public morality, customs and laws and shall not include political messages; and all financial rights including publishing rights, processing and copying, distributing, representation, communicating to public devices, enabling the transmission of signs, sounds and/or images, transfer and assignment to third parties set forth under the Law on Intellectual Property Rights numbered 5846 and dated 5.12.1951 have been transferred to Yemeksepeti.
Users shall not use a username, picture or a nickname and shall not send a message or a comment of such that is threatening, unethical, racist, against the laws of the Republic of Turkey and international agreements, containing political messages or violating the intellectual or industrial property rights of third persons.
User holds liability for any personal idea, thought, expression, documents added to Yemeksepeti, personal information shared with Yemeksepeti and Yemeksepeti shall not be held liable for any dispute including but not limited to those arising between the member merchants and the user, and Yemeksepeti has full discretion to publish or not to publish any such opinions and thoughts and holds the right to edit and correct spelling errors of such opinions and comments through its moderators.
Product images in Yemeksepeti systems are only for explanatory purposes and may differ from the real ones.
Yemeksepeti has right to publish in any kind of visual and written media, process, share in social media networks and/or transfer to any other address within Yemeksepeti system that is found appropriate by Yemeksepeti., or to remove from it’s system any information, documents, software, design, graphics, works and etc.(i.e. pictures of the user, messages, poetry, news, files and etc. added to the board) which are produced by Yemeksepeti users and uploaded to the system by their own will for publication of the same. It is possible for such information to be copied, processed and/or published by other users. In this case, the user shall not claim any royalty payment from Yemeksepeti.
13. Retention of Information and the Burden of Proof
Users accept that user information (e.g. user order information, user’s comments etc.) kept in Yemeksepeti’s databases and servers within the limits set out under relevant legislation. This information shall constitute evidence for any and all disputes which may arise in connection with the Terms, and that this clause herein constitutes an evidence agreement.
14. Applicable Law and Competent Courts and Execution Offices
The Terms herein are governed by and shall be construed in accordance with the laws of the Republic of Turkey.
All disputes arising from this Agreement İstanbul Central (Çağlayan) Courts and Execution Offices shall have jurisdiction.
15. Force Majeure
Parties shall not be held liable for late or incomplete performance of any of its obligations under the Terms or for its failure to comply with any of its obligations herein in case of any events which may objectively prevent or delay its compliance with its obligations including but not limited to adverse weather conditions preventing transportation, transportation disruptions, infrastructure and internet malfunctions, fire, earthquake, flood and other natural disasters as well as extraordinary events including epidemics, turmoil, widespread violent acts, strikes or regulations by official authorities. In this case the Parties, suspend performing their obligations.
16. Effective Date
This Agreement shall enter into force as of the user’s registration date and the user accepts that it will be bound by the Terms until the user's membership continues.
17. Termination
The Parties may terminate this Agreement whenever they may wish. In case of termination of the Agreement, the Parties shall mutually perform the rights and obligations arising up to the date of termination.
